New regulations on Vietnamese Labour Law: Guidelines on maternity entitlement

ANT Lawyers – On April 23rd 2013, the Social Security of Vietnam issued Document 1477/BHXH-CSXH which provides new guidelines for the 6-month maternity entitlement under the provisions of the new Labor Code of Vietnam.

This document specifies cases where female employees are entitled to 6 months of maternity health insurance and the local requirements to implement it.

Further instructions for the maternity leave period from May 1st 2013 convey:

 –          Maternity entitlement is determined from the date when the female employee actually leaves for the childbirth;

–          In cases when the employee leaves more than 2 months before the actual childbirth, the maternity entitlement shall be discounted by those 2 months.

This takes effect on the signing date.
