In order to unify the management of the construction permit for buildings and individual houses Sept, 04th 2012 , The Government issued Decree No. 64/2012/NĐ-CP on license of building permit.
In particular, It is noted that the regulation for each building permit is only extended once Before 30 days from expiring day. After six months the day of extending building permit if investors don’t begin executing the construction, this permit will be recovered. Also, building permit can be recover in the case: building permit is not granted according to current regulations; over the time limit in the violation text, investors still have not overcome the violation by request of the competent authority (in the case building of the wrong construction based on building permit granted).
After ten work days from the day having the decision to withdraw the building permit which investors do not return, the competent authority have the right to cancel this building permit, and notify commune- level People’s committee and the information posted on the website of Department of Construction.
Beside, The Government also provides detail information about conditions to grant building permit for buildings and individual houses as following: buildings and individual houses must comply with the construction plan, the purpose of land use, investment goal…; organizations, individuals with enough conditions and capacity based on the regulation with the building design profile carry out; designs must be evaluated, approved based on the regulation. For individual houses with the total area under 250 m2, under 3 floors and not located in the region of protecting historical and cultural value, investors is permitted to design by themselves and be responsible for the safety of the construction and neighborhood constructions.
