Guide for compensation in criminal proceedings

Prisoners who died in their custody or detention, imprisonment without their own fault or a force majeure event will be compensated with the mental damages at 360 months minimum wage.

This is one of the contents are specified in detail in The Joint Circular 05/2012/TTLT-VKSNDTC-TANDTC-BCA-BTP-BQP-BTC-BNNPTNN guiding the implementation of the state to compensate in criminal proceedings.

This amount of money is compensated for relatives of the victims (spouses, parents, foster parents, biological children, adopted children, foster victims).

Relatives of the died person will also receive compensation for physical healing, the funeral of the victim, child support (if any).

In addition, this Circular give instructions on how to calculate the loss of physical and mental of other cases.

Circular replaces TTLT 04, 2006, and takes effect from December 17th 2012.
