Previously, when unilateral termination of labor contracts, employee must be certified by the employer that the termination is legal then he/she will be eligible for unemployment insurance (UI).
However, from January 15th 2013, employee just need to be certified by the employer on the unilateral termination of the contract to complete the documents entitled to unemployment insurance for this case.
Labor users will be responsible for providing written certification for their employees to receive unemployment insurance.
Also from that point of time, the deadline to register for unemployment will be extended to 3 months from the date of loss of or termination of the labor contract (this period used to be 7 days.)
The unemployment insurance procedures is prescribed in Decree 100/2012/ND-CP on November 21st 2012 amending and supplementing a number of articles of Decree 127/2008/ND-CP.
Decree takes effect from January 15th 2013.
