Circular 26/2012/TT-BKHCN dated January 5th 2013 of the Ministry of Science and Technology on the handling of low-quality imported goods
Upon the detection of imported goods circulated on the market that are not in accordance with the published standards and the corresponding technical regulations, the inspection agencies will consider inspecting the quality of imported goods.
If quality of goods do not meet specified requirements, depending on the nature and seriousness of the violation, the inspection agencies will propose the competent agencies to apply one or all of the following remedial measures:
– Require the exporter to re-export those goods
– Request the importer to recycle or destroy those goods as regulated
– The product quality inspection agency might consider strengthening the goods checking at the border or recommend the State competent agencies to decide to pause or stop the importing of those goods
Sequence and test procedure will be conducted in accordance with this Circular, taking effect from January 27th 2013 and replace Circular 16/2009/TT-BKHCN dated June 2nd 2009.
