According to the provisions of this Decree, the acts of producing fake stamps, labels, packaging of goods which are food, drug prevention, drug treatment, cosmetics, medical equipment, animal feed, fertilizers, veterinary drugs, plant protection drugs, plant varieties, animal breeds, cement, construction steel helmets will be fined double compared with the fine specified in this Decree.
Decree also specifies that, depending on the violation, the nature and seriousness of the violation, the violator that conducting the act of producing counterfeit goods can be fined from 200,000 VND to 100 million VND; the acts of trafficking in counterfeit goods can be fined from 100,000 VND to 70 million VND.
Apart from the fine, the Circular also provides a number of additional sanctions for acts of producing and trading counterfeit goods, such as: confiscation of material evidences, means of violation; deprived of the right to use the definite or indefinite period of license, certificate of practice and other measures to overcome the consequences of the acts of production and trade of counterfeit goods.
Decree takes effect from March 1st 2013 and revoke Clause 8 – Article 3, Article 24, Article 25 of Decree 06/2008/ND-CP dated January 16th 2008, Clause 6 – Article 3, Article 7, Article 10 of Decree 15 / 2010/ND-CP
