The newly issued Decree 24/2013/ND-CP has a number of adjustments in the marriage procedure that has foreign elements in Vietnam as follows:
For marriage dossier:
– Remove the provisions on the requirement of notarization and legalization of household registration and identity proof.
– Add some cases that must supplement the dossier: divorced in foreign country, Vietnamese resident that has foreign nationality.
The marriage registration procedure is adjusted as follows:
– Spouse could submit the dossier.
– Standby time to interview is reduced to within 15 days and the marriage certificate will be issued after the interview within 05 working days.
– Remove the regulation that the marriage must be listed at the office of the Department of Justice.
– Where in good causes, the date of marriage ceremony may be extended (maximum 90 days).
Decree takes effect from May 15th 2013, replacing Decree 68/2002/ND-CP and Decree 69/2006/ND-CP.
