Resolution 02/NQ-CP on the solution to solve difficulties for business

In order to achieve the objectives and tasks to develop socio-economic in 2013 as well as to overcome difficulties, create favorable conditions for business to develop, on January 7th 2013, the Government issued Resolution 02/NQ-CP on the solution to solve difficulties for business. Accordingly:

Extend 6 months time limit to pay income tax on the amount of tax payable for the 1st quarter and 3 months time limit for the payment of corporate income tax for the tax payable for the 2nd quarter and the 3rd quarter of 2013 for the following subjects:

– Small and medium-sized enterprises (employing less than 200 employees working full time and have no more than 20 billion VND in revenue)

– Enterprises that use more labor (more than 300 employees) in the field of production, processing, processing of agricultural, forestry and aquatic products, textiles, footwear, electronic components, construction of the social and economic infrastructure.

– Investment and trading enterprises (sale, lease, hire purchase) housing are extended time to pay taxes on income from investments – trading houses, regardless of firm size and number of employees used.

Extension of 6 months time limit to pay VAT on the VAT payable in January, February, March 2013 for the following enterprises that are paying VAT by the credit method:

– Small and medium-sized enterprises (employing less than 200 employees working full time and have no more than 20 billion VND in revenue per year), excluding enterprises operating in the fields of finance, banking, insurance , stocks, lotteries, gaming, production of goods and services subject to special consumption tax.

– Enterprises that use more labor (more than 300 employees) in the field of production, processing, processing of agriculture, forestry, aquatic products, textiles, footwear, electronic components, construction of the social and economic infrastructure.

– Investment and trading enterprises (sale, lease, hire purchase) housing and businesses producing products: iron, steel, cement, bricks, tiles (only extend the amount of VAT payable for the products which is housing, iron, steel, cement, bricks, tiles, the case absence of separate accounting is then allocated according to the proportion of revenue).

Refund the environmental protection tax paid from January 1st 2012 to November 14th 2012 for nylon bag for packaging products in accordance with Decree 69/2012/ND-dated September 14th 2012 of the Government.

Discount 50% of the land use fee in 2013, 2014 for economic organizations, households and individuals that are leased by the State that the land use fee is payable under the provisions of Decree 121/2010/ND-CP dated December 30th 2010.

Investors of projects if facing with financial difficulties can delay the payment of land use fee in 2 years.

Shorten the clearance time, strengthen the declaration of tax online, boosting tax payment through the banking system, promote automate the process of receiving dossiers, tax, administrative and custom procedures. Striving to reduce 10-15% of the costs to comply with the administrative procedures of customs duties for individuals, organizations and businesses.

Minister of Finance submited to the National Assembly for consideration and decide:

– Application of corporate income tax rate of 20% from July 1st 2013 (6 months ahead of the projected route for small and medium-sized enterprises).

– Application of corporate income tax rate of 10% from July 1st 2013 (6 months ahead of the expected schedule for the income from social housing business. Social housing is determined in accordance with the provisions of the law on housing).

– Reduction of 50% of the number of output value added tax from July 1st 2013 to June 30th 2014 for the activities of investing and trading social housing.

– Reduction of 30% of the number of output value added tax from July 1st 2013 to June 30th 2014 for investment and business activities (sale, lease, hire purchase) housing which is apartments with floor area of less than 70m2 and has selling price of more than 15 million VND/m2.

– Additional tax incentives for investment to expand in the preferred field, industry or geographical in accordance with the Enterprise Income Tax Law for implementation from July 1st 2013 (6 months ahead of the planned route of the Law to amend and supplement a number of Articles of the Law on Corporate Income tax). The time applying exemption and reduction to expanded investment equal with the time the tax exemption and reduction apply to new enterprises established in the same area, field of preferential enterprise income tax.
