Circular 41/2012/TT-BCT on mineral export restrictions
Enterprises satisfying the conditions specified in Circular 41/2012/TT-BCT of the Ministry of Industry and Trade issued on December 24th 2012 will be allowed to export minerals.
Accordingly, the first condition for enterprises to be able to export minerals is that, the minerals subject to export must be listed in in the Circular.
This list is now containing only 10 type of minerals, less than previously regulated (22).
In terms of mineral origin, these conditions are now more relaxed which allow minerals which are legally imported or confiscated and sold by the state agencies for export.
In addition, in some special cases, enterprises can report to the Provincial People’s Committee for consideration on the export of minerals that does not meet the above conditions.
Circular takes effect from February 4th 2013, replacing Circular 08/2008/TT-BCT.
